Prog Organ - END USER LICENSE AGREEMENT (EULA) 17 January 2006 In what follows the word 'software' means any or all of the material provided in the Prog Organ package, including but not limited to computer programs, SoundFonts and written material related to its use. 1. GRANT OF LICENSE This is a single user license. You are granted the right to use one copy of the software constituting the Prog Organ system on a single terminal connected to a single computer, subject to the terms included herein. You may not network the software or otherwise use it or attempt to use it on more than one computer at the same time. 2. COPYRIGHT AND TRADEMARKS The software is the copyright of Colin E Pykett except where otherwise stated. Prog Organ is a trademark of Colin E Pykett. You may make one copy of the software solely for backup or archival purposes. You may not further copy or distribute the software. (a) The name PortTalk and the associated material is the copyright of Craig Peacock. (b) The name KX and the KX Project and the associated material is the copyright of Eugene Gavrilov. (c) The name 7-ZIP and the associated material is the copyright of Ivor Pavlov. Use of the material denoted in (a), (b) and (c) above is governed by the licensing arrangements for that material. 3. RESTRICTIONS You may not rent or lease the software and/or the accompanying written materials or transfer them to another person or entity or make them available to others in any form or in any way, including on the Internet. 4. DISCLAIMER The software (including instructions for its use) is provided "AS IS" without warranty of any kind. Any and all implied warranties are disclaimed including without limitation any implied warranties of merchantability or of fitness for purpose. In no event shall the owners or originators of the software and its accompanying written materials be liable for any unwanted consequences arising from its use. The author does not warrant that the functions provided by the software will meet your requirements or that the operation of the software will be uninterrupted or error-free or free from malicious code. For purposes of this paragraph, 'malicious code' means any program code designed to contaminate other computer programs or computer data, consume computer resources, or in some other fashion disrupt the normal operation of the computer, computer system, or the computer network to which it is connected. In no event will the author or his agents and/or associates be liable for use of this software for any illegal and/or criminal purpose. Use for such purposes is prohibited by this agreement. 5. ACCEPTANCE OF EULA By installing, copying, or making any use of this software you agree to be bound by the terms of this agreement. If you do not agree, do not use or install the software and immediately remove any and all downloaded or installed versions from your computer system and/or storage archives. 6. ASSIGNMENT OR TRANSFER OF LICENSE This license may not be assigned or transferred to another person or entity. 7. RIGHTS AND LIMITATIONS INCLUDING USE FOR PROFIT AND/OR GAIN You agree to not permit or cause any removal or modification of copyright or proprietary notices, file name changes or any modification or additions to the files provided of whatever kind. You agree the software may not be sold or included in any commercial product or package without specific written permission of the author. Use for any form of profit or gain is likewise prohibited without such permission, including but not limited to use in activities related to your business or profession. For example, you may not refer to or use this software for promoting your own interests or products. Nor must you refer to or use the software in a manner which compares this software unfavourably with such interests or products. Only sites and/or sources approved by the author in writing are allowed to distribute this software. 8. DECOMPILING, DISASSEMBLING OR REVERSE ENGINEERING You may not decompile, disassemble or otherwise reverse engineer the software, or engage in any other activities to obtain information that is not visible to the user in connection with normal use of the software. 9. CORRESPONDENCE You will regard any correspondence between you and the author on matters related to Prog Organ and/or any other subjects as private and confidential. You undertake not to make such correspondence available in any way to other parties or entities without written permission from the author. 10. GOOD FAITH The material you have received is provided in good faith at your request. In return you undertake not to demonstrate or otherwise represent it in any way to other parties or entities in any manner which could be construed by the author or his agents/representatives as damaging the interests, person, character or standing of the author or which could call into question his professionalism and/or competence. 11. TERMINATION OF LICENSE This agreement may be terminated and your license to use the software withdrawn should you fail to comply with this agreement. In this event, you agree to immediately remove the software and any accompanying material from your computer system and destroy any remaining copies.
